1. Summary of the main conditions of sale

These General Terms and Conditions govern the remote sales service of Products (hereinafter the Service), on the www.orologiswp.it of OrologiSWP by OrologiSWP (hereinafter the "Seller"). 

1.2 Before making your purchase, please read these General Terms and Conditions of Sale in full.

The following are the main terms and conditions of the Service: 

• Product shipments take place from ITALY.
• Price and presentation of the products: where not expressly indicated, the prices of the Products are expressed in Euro, include VAT and shipping costs, the images of the Products offered for sale on the Site may not correspond to the real ones due to the Internet browser and monitor used.
• Method of purchase: in order to purchase one or more Products, you must carefully fill out and transmit to the Seller electronically a Purchase Order (which counts as a binding contractual proposal) that summarizes information on the essential characteristics of each Product ordered and its price, means of payment, delivery methods, and shipping costs. By submitting your Purchase Order, you confirm that you understand and accept the General Terms and Conditions of Sale.
• Order Fulfillment: following receipt of the Purchase Order, Seller transmits confirmation of your acceptance or, if applicable, indicates the reasons why your order will not be fulfilled by reimbursing you for what you have paid. Shipment will take place only after proper registration of payment within no more than 5 business days of receipt of the Purchase Order.
• Warranty: all Products available on the site are guaranteed for conformity defects manifested as provided by the Italian jurisdiction. To benefit from warranty service, you must keep the receipt (or invoice), attached to the purchased product. Right of withdrawal for non-food goods purchased on our site: you have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fifteen (15) working days from the day of receipt of the Products purchased on the site. On how to exercise this right, see the following articles on return and exchange policy. Please note: Customers who purchase with VAT number cannot exercise the right of withdrawal.

2. Product Information and Pricing

2.1 All information on the essential characteristics of the Products is provided within the identification sheet of each Product.

2.2 The prices of the Products are expressed in Euros and (where not expressly indicated) are always inclusive of VAT and do not include shipping costs. The prices indicated on the Site may be subject to updates, we therefore invite you to check the final sale price before submitting the relevant Purchase Order.

3. Methods of concluding the purchase contract

3.1. In order to conclude a purchase contract for one or more Products on the Site, after selecting the Product(s) you are interested in, you must first complete and transmit to the Seller a Purchase Order for the selected Products in electronic format (which shall count as a contractual proposal), indicating the Products you are requesting to purchase, the payment method you have chosen and certain of your necessary personal data (hereinafter the Purchase Order).

3.2. The Purchase Order consists of a "Master Data" screen in which you must indicate the personal data necessary for delivery and a screen for selecting and activating your chosen means of payment (as further set forth in Article 4 below). The Purchase Order also contains a summary: of the information on the essential characteristics of each Product ordered and its price, the means of payment available to complete the Purchase Order and the shipping costs.

3.3. Your Purchase Order will be stored in our database for the period of time necessary to process your orders (and otherwise within the terms of the law). You will be able to access your Purchase Order at any time to monitor its status by connecting to the Site and accessing the "my orders" section.

3.5. The contract is concluded when the Seller electronically receives and accepts your order, after verifying that the data of your order are correct. The Seller may not process the orders: (a) when they don’t give sufficient guarantees of solvency or when are incomplete/incorrect; (b) in case of unavailability of the products (if no longer available or on sale). In these cases, the Seller will promptly inform you by email (within 30 days from the receiving of the order) that the contract is not concluded and will specify the reasons. In casa you have already payed the product and the shipping costs, you will be totally refunded (as better specified in art. 5).

In case the Seller intends to conclude the contract, he will send you, via email, a receipt of the order, containing a summary of the information about the order itself.

4. Term of payment

4.1. After having placed the order, you will be asked to choose one of the following payment methods:

a)Advanced bank transfer made out to the seller;

b) Credit Card;

c) PayPal. 

4.2. In case of payment by advance bank transfer, you will receive an indication of the bank details to which to make the transfer. We invite you to check the completeness and correctness of the references and essential elements of the bank transfer. Missing data or the absence of necessary references may cause delays in processing orders and in the subsequent delivery of the Products. 

4.3. In case of purchase using Credit Card / PayPal payment method, at the end of the Purchase Order compilation procedure, you will automatically be directed to the IT platform owned by PayPal which will manage the entire payment transaction. Here you can choose whether to pay with a credit card or with your PayPal account

In case of payment with:

• your PayPal account: the amount relating to the order will be debited from your PayPal account upon receipt of the order by the Seller.
• a credit card: the amount relating to the order will be charged to your credit card.

Under no circumstances can the Seller be held responsible for any damages, direct or indirect, caused by delays in the failure to release the committed amount by PayPal. 

At no stage of the purchase procedure on the site is the Seller able to access your financial information or know it. In any case, the entire transaction is managed by PayPal which will send you a confirmation email for each transaction.

5. Shipping and delivery of the Products

5.1. The shipment of the Products is carried out to the address indicated in the Purchase Order only after the regular registration of the order payment. No deliveries will be made to post office boxes. In any case, the Seller will ship the Products no later than 5 working days from the day of receipt of payment. 

5.2. We only ship to Italy. Deliveries in Italy will be completed on average within 5 working days from the date of shipment, with the exception of Saturdays, Sundays and holidays in general. The delivery terms just indicated are to be considered purely indicative. The Seller will not be in any way responsible for any delivery delays due to causes not attributable to it.nbsp;

5.3 The shipment will be accompanied by an invoice / receipt issued by the Seller.

6. Product quality and guarantees

6.1. The Seller does not sell Products. You are aware and accept that the images and colors of the Products offered for sale on the site may however not correspond to the real ones due to the Internet browser and monitor used. 

7. Right of withdrawal

7.1. You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fifteen (15) working days from the day of receipt of the Products purchased on the site. 

To withdraw from the contract, you must first send an email to: info@orologiswp.it to obtain authorization for the return and all the instructions necessary to proceed with the withdrawal. 

You will be responsible for shipping costs, including liability in the event of loss or damage to the Products. 

7.2. The right of withdrawal - in addition to compliance with the terms and methods described in the previous point 7.1 - is considered exercised correctly if the following conditions are also fully respected: 

1. a) the Products must not have been used, opened, worn, washed or damaged;
   b) the identification tag (if present) must still be attached to the Products;
   c) the Products must be returned in intact packaging, adequately sealed with intact, original and complete packaging and contents;
   d) the returned Products must be sent to the Seller in a single shipment. The Seller, in fact, reserves the right not to accept Products from the same order, returned and shipped at different times

7.3. If the right of withdrawal is exercised following the methods and terms indicated in this paragraph 7, the Seller will refund any sums already collected for the purchase of the products. 

The sums will be refunded to you as quickly as possible and, in any case, within thirty (30) days from the date on which the Seller became aware of the exercise of your right of withdrawal, we will activate the reimbursement procedures pursuant to the following paragraph 9, once the correct execution of the terms and conditions indicated above has been verified. 

7.4. If the methods and terms for exercising the right of withdrawal are not respected, as specified in this paragraph 7, you will not be entitled to a refund of the sums already paid to the Seller; however, you will be able to regain, at your expense, the Products in the condition in which they were returned to the Seller. Otherwise, the Seller may retain the Products, in addition to the sums already paid for their purchase. 

Refund times and methods

9.1. After returning the Products, the Seller carries out the necessary checks relating to their conformity with the conditions and terms indicated in paragraph 7.1. and 7.2. If controls are concluded positively, the Seller will send you, via email, the confirmation of acceptance of the Products thus returned.  

9.2. Whatever payment method you use, the refund procedure is activated by the Seller as quickly as possible and in any case within thirty (30) days from the date on which the Seller became aware of the exercise of your right of withdrawal, after verification of the correct execution of your right of withdrawal and acceptance of the returned Products 

9.3. If there is no correspondence between the recipient of the Products indicated in the Purchase Order and the person who paid the sums due for their purchase, the refunding of the sums, in the event of exercise of the right of withdrawal, will be carried out by the Seller, in any case, towards the person who made the payment. 

10. Major force events

The Seller will be relieved from any contractual obligation to make or deliver and will not be required to pay any compensation in the event of major force events that prevent the fulfillment of obligations placed upon you, such as, but not limited to, riots, insurrections, disturbances. social issues, telephone or IT failures or serious damage to the security and operation of the internet, strikes and impossibility of supply of Products and materials. 

11. Applicable law and dispute resolution

11.1 The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree no. 6 September 2005. 206 (Consumer Code) with specific reference to the legislation regarding distance contracts and Legislative Decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce. 

12. Periodic update

The General Conditions of Sale are modified from time to time also in consideration of any regulatory changes. The new General Conditions of Sale will be effective from the date of publication on the site. We therefore invite you to periodically consult this section to check for any updates.
